Terms of Service
These Terms govern your use of The Top Pour, a digital bartender companion operated by Villanueva Hospitality Group LLC ("VHG," "we," "us," or "our") and branded as The Top Pour by STSB.
1. Eligibility and acceptance
You must be at least 18 years old to create an account or purchase The Top Pour. By accessing the service, creating an account, or purchasing a plan, you agree to these Terms. You are responsible for complying with all laws that apply where you live or work, including legal drinking-age and alcohol-service requirements.
2. The service
The Top Pour provides bartender education, cocktail recipes, bar-inventory tools, event-planning estimates, personal recipe and calendar tools, and related features. Some features may be labeled as previews, beta features, or future features and may change as the product develops.
3. Accounts and security
You may need an account to verify purchases, Lifetime Core access, AI-credit balances, and AI+ status. You are responsible for keeping your credentials secure and for activity under your account. Please contact us if you believe your account has been accessed without authorization.
4. Lifetime Core access
A one-time Lifetime Core purchase grants the purchasing user a personal, non-exclusive, non-transferable license to use the Core features of The Top Pour without a recurring Core subscription fee, for as long as The Top Pour Core is made available and supported by us. The purchase does not transfer ownership of the software, content, trademarks, or other intellectual property.
5. AI credits and AI+
Lifetime Core includes the starter AI-credit amount shown at checkout. Eligible AI features may consume credits when a live AI service is enabled. Top Pour AI+ is an optional annual subscription that may include Professional Inventory, expanded AI allowances, and other premium features shown at the time of purchase. AI+ automatically renews unless canceled before renewal. Canceling AI+ does not cancel or remove Lifetime Core access.
6. Billing through Paddle
Purchases are processed by Paddle, our authorized reseller and Merchant of Record. Paddle handles payment processing, applicable transaction taxes, receipts, and certain billing and refund functions. Your transaction is also subject to Paddle's buyer terms and policies presented during checkout. We do not store full payment-card numbers.
7. Local data and backups
Core user-created data such as My Bar inventory, saved creations, calendar entries, and certain preferences may be stored locally in your browser or device. Unless a cloud-sync feature is expressly provided, you are responsible for maintaining any exports or backups you want to preserve. Clearing browser data, switching devices, or resetting local data may remove locally stored information.
8. Educational guidance and alcohol responsibility
The Top Pour is an educational and planning tool, not legal, medical, safety, or professional compliance advice. Recipes, inventory recommendations, event quantities, costing tools, and AI-assisted guidance are estimates and may not fit every venue or situation. You remain responsible for professional judgment, safe service, food and alcohol regulations, licensing, responsible beverage service, purchasing decisions, and event execution. Never use the service to encourage unsafe or unlawful alcohol consumption.
9. Acceptable use
You may not misuse the service, attempt unauthorized access, disrupt its operation, bypass paid-access controls, copy or resell protected content or access, scrape the service at scale, reverse engineer except where law expressly permits it, or use the service in violation of law or third-party rights.
10. Intellectual property
The Top Pour software, design, branding, training content, written explanations, recipes as presented, databases, graphics, and other original materials are owned by or licensed to VHG and are protected by applicable intellectual-property laws. "The Top Pour," "The Top Pour by STSB," and related branding may not be used in a way that suggests endorsement or affiliation without permission.
11. Changes, availability, and maintenance
We may improve, reorganize, replace, add, or retire features, and we may perform maintenance or respond to security, legal, or technical requirements. We will try to avoid materially reducing paid functionality without good reason and will communicate material changes when appropriate. We do not guarantee uninterrupted or error-free availability.
12. Suspension and termination
We may suspend or terminate access for fraud, chargebacks, material violations of these Terms, abuse of the service, security threats, or legal requirements. Where reasonable, we will provide notice and an opportunity to resolve the issue. Sections that by their nature should survive termination will continue to apply.
13. Refunds and cancellations
Our customer-facing refund rules are described in the Refund Policy. Mandatory consumer rights always apply where required by law. AI+ can be canceled for future renewal through the billing tools provided by Paddle or the methods shown in your purchase confirmation.
14. Disclaimers
To the maximum extent permitted by law, The Top Pour is provided on an "as is" and "as available" basis. We disclaim warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where those warranties cannot legally be excluded.
15. Limitation of liability
To the maximum extent permitted by law, VHG will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business, goodwill, or data arising from use of The Top Pour. Our aggregate liability for claims relating to the service will not exceed the amount you paid for the applicable Top Pour product during the 12 months before the event giving rise to the claim, or the total amount paid for a Lifetime Core purchase if that is the only purchase at issue. These limits do not apply where liability cannot legally be limited.
16. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except that mandatory consumer-protection laws in your jurisdiction continue to apply where required. Any dispute not subject to a mandatory alternative forum will be brought in a court of competent jurisdiction in Texas.
17. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date will show when changes were made. If a change materially affects your paid rights, we will provide reasonable notice when required or appropriate.
